Guardianship and Conservatorship Matters

A Guardianship is a court proceeding for the appointment of an individual to provide care and to make personal decisions for a minor or an incapacitated adult. A Conservatorship is a court proceeding to appoint an individual or a corporation as a fiduciary similar to a trustee, to manage the financial affairs of a minor child or an incapacitated adult who cannot manage his or her own property or financial affairs. The same person or different persons can be appointed to serve as Guardian and Conservator for a minor child or incapacitated adult. Of course, if possible through the estate planning process, the goal is to try to avoid the need for court proceedings and the appointment of either a Guardian or Conservator. However, there are times when there is no other alternative. Obtaining the appointment of a Guardian or Conservator, or both, can be a very complicated and emotional process.
